Agreement to Our Legal Terms

We are noticed.cv (“Company,” “we,” “us,” or “our”).

We operate the website https://noticed.cv (the “Site”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

noticed.cv is an AI-powered resume coach for college students and recent graduates with little to no work experience. Through a guided chat interview, our AI helps users surface achievements from their projects, internships, and student activities, then generates a clean, ATS-friendly resume in PDF format.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and noticed.cv, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Legal Terms, and you waive any right to receive specific notice of each such change. Where material changes are made, we will notify you by email at the address you have provided to us. It is your responsibility to periodically review these Legal Terms to stay informed of updates.

The Services are intended for users who are at least 18 years of age. Persons under the age of 18 are not permitted to use or register for the Services.

1. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The Services are provided for your personal use to help you create a resume based on the information you provide.

2. Intellectual Property Rights

Our intellectual property

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, and the “noticed.cv” name and branding (collectively, the “Content”), as well as the trademarks, service marks, and logos contained therein (the “Marks”).

Our Content and Marks are protected by copyright and trademark laws and are provided “AS IS” for your personal use only.

Your use of our Services

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and to download or print a copy of any resume you generate, solely for your personal, non-commercial use.

Your submissions and contributions

By submitting any information, text, or other content to the Services (your “Contributions”), you represent and warrant that:

  • You own or have the necessary rights to your Contributions, and the information you provide is truthful and accurate to the best of your knowledge.
  • Your Contributions do not infringe the rights of any third party, including intellectual property rights or privacy rights.
  • Your Contributions are not false, inaccurate, or misleading in a manner intended to deceive.

You retain full ownership of your Contributions and the resume you generate. By submitting Contributions, you grant us a limited license to use, process, and store that content solely for the purpose of providing the Services to you, in accordance with our Privacy Policy.

3. AI-Generated Content Disclaimer

Our Services use artificial intelligence (AI) to help generate resume content based on the information you provide. The AI may organize, rephrase, or format your input.

You are solely responsible for reviewing, verifying, and ensuring the accuracy and truthfulness of all content in your final resume before using it. We do not guarantee that AI-generated content is accurate, complete, or suitable for any particular purpose, including job applications or interviews.

We are not responsible for any consequences arising from inaccurate, misleading, or fabricated information in your resume. By using our Services, you acknowledge that the final resume is your own representation and that you bear full responsibility for its content.

4. User Representations

By using the Services, you represent and warrant that: (1) you have the legal capacity and you agree to comply with these Legal Terms; (2) you are not under the age of 18; (3) you will not access the Services through automated or non-human means, whether through a bot, script, or otherwise; (4) you will not use the Services for any illegal or unauthorized purpose; and (5) your use of the Services will not violate any applicable law or regulation.

5. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:

  • Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  • Use the Services to advertise or offer to sell goods and services.
  • Sell or otherwise transfer your profile or account.
  • Circumvent, disable, or otherwise interfere with security-related features of the Services.
  • Use the Services in a manner inconsistent with any applicable laws or regulations.
  • Upload or transmit viruses, Trojan horses, or other material that interferes with any party's uninterrupted use and enjoyment of the Services.
  • Attempt to impersonate another user or person.
  • Use any information obtained from the Services in order to harass, abuse, or harm another person.

6. Purchases and Payment

We accept the following forms of payment, processed through our third-party payment provider:

  • Mastercard
  • American Express
  • Discover

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. All payments shall be in US dollars (USD).

You agree to pay all charges at the prices then in effect for your purchases, and you authorize us (through our payment processor) to charge your chosen payment provider for any such amounts. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

7. Refunds Policy

Refunds are available for any purchase before the resume PDF has been downloaded.

Once the PDF has been downloaded, the purchase is considered fulfilled and is non-refundable.

8. Third-Party Websites and Content

The Services may contain links to other websites (“Third-Party Websites”) as well as content belonging to or originating from third parties. Such Third-Party Websites and content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Services or any content posted on, available through, or installed from such websites.

Inclusion of, linking to, or permitting the use of any Third-Party Website does not imply approval or endorsement by us. If you decide to leave the Services and access Third-Party Websites, you do so at your own risk.

9. Copyright Infringements

We respect the intellectual property rights of others. If you believe that any material available on or through the Services infringes upon any copyright you own or control, please immediately notify us at hello@noticed.cv. Please provide sufficient detail to allow us to identify and address the alleged infringement.

10. Services Management

We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Legal Terms; and (3) otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms.

12. Term and Termination

These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Services to any person for any reason, including for breach of any representation, warranty, or covenant contained in these Legal Terms or of any applicable law or regulation.

13. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Services without notice at any time.

We cannot guarantee the Services will be available at all times. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.

14. Governing Law

These Legal Terms shall be governed by and defined following the laws of China. You and noticed.cv irrevocably consent that the courts and applicable authorities of China shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms, subject to the dispute resolution provisions below.

15. Dispute Resolution

Informal negotiations

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (each a “Dispute”), you and we agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one person to the other.

Binding arbitration

If you and we are unable to resolve a Dispute through informal negotiations, the Dispute will be finally and exclusively resolved by binding arbitration. The arbitration shall be commenced and conducted in Shangrao, China. The arbitration shall be conducted in the English language, and there shall be one (1) arbitrator.

16. Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US.

THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
